For the first time in at least 40 years, there are no vacancies on any federal circuit court. Today's confirmation of Cory Wilson to the U.S. Court of Appeals for the Fifth Circuit cemented President Trump's 200th pick of federal judges in just under 4 years.
The 52-48 Senate confirmation gives Trump his 53rd circuit court judge confirmed within 4 years compared to Obama's 55 in 8 years. It's interesting to note that this is the fastest pace of confirmations of federal judges just behind Democratic president Jimmy Carter. Trump's appointments has flipped the 2nd, 3rd and 11th Circuits, which were previously a liberal majority, conservative, and skimmed the left-leaning 9th Circuit from a domination of plus 11 liberal judges to just plus 3.
Today's confirmation of Wilson was met with outrage from Democrats, as were previous confirmations. Sheldon Whitehouse, a Democratic Senator from Rhode Island, Tweeted "Judicial nominee Cory Wilson called the Affordable Care Act 'illegitimate' & 'perverse. He called the NAACP’s concerns about Voter ID laws 'poppycock.' He called groups like the ACLU 'rent-a-mobs.' I call him unqualified & will be voting no on his nomination."
The President and CEO of left-leaning advocacy group the Leadership Conference on Civil and Human Rights Tweeted out images of a letter she drafted opposing Wilson's confirmation that read "The Senate should not consider Mr. Wilson’s nomination – or any judicial nomination – at this perilous time in our nation’s history, when the Senate should be laser focused on efforts to save lives and mitigate the profound economic turmoil of COVID-19 on the American people. It is especially disturbing that the Senate would process judicial nominees like Mr. Wilson who seek to dismantle health care protections for vulnerable people."
Seemingly it's okay to blast Republicans for not being "laser focused" on saving lives during these troubling times, but it's fine when Democratic New York City Mayor Bill De Blasio is "laser focused" on installing a Black Lives Matter mural in front of Trump Tower to troll the president or when Democrats shut down a vote to debate a police reform bill solely constructed by Senate Republicans.
On June 18th, Trump Tweeted that he was planning on releasing a list of names of possible conservative nominees to the Supreme Court by September 1st. Democrat presidential hopeful Joe Biden still has yet to release a list of nominees despite the urging of those within his party.
Instead, Biden chimed in on Twitter saying "Instead of passing police reform or helping hardworking Americans get through this crisis, Republicans are jamming through another one of Trump’s unqualified nominees. It's wrong. Cory Wilson lacks judicial temperament and experience—and has no place on a Federal Court."
