Soros-Backed California DA Issues "Looting Guidelines" for Officers to Follow

In early July, a duo in Martinez, California were charged with a hate crime for painting over a BLM mural. The two face felony charges in violation of civil rights, vandalism, and possessing tools to commit vandalism. The same district attorney who charged the two is caught up in yet another controversial situation.

Contra Costa County California District Attorney Diana Becton, a George Soros-backed first-term elected official, issued an outline for police in her county to follow when determining who to arrest when caught looting. Rather than issuing a felony right away, she's ordering police to determine whether or not the looter "needed" the stolen goods.

Here's her "looting guidelines" provided to RedState by a confidential source:

  1. Was the target business open or closed to the public during the state of emergency?

  2. What was the manner and means by which the suspect gained entry to the target business?What was the nature/quantity/value of the goods targeted?

  3. Was the theft committed for financial gain or personal need?

  4. Is there an articulable reason why another statute wouldn’t adequately address the particular incident?

Under California law, "looting" is defined as: "taking advantage of a state of emergency to commit burglary, grand theft or petty theft. Looting charges can be filed as a misdemeanor or a felony and is punishable by up to 3 years in jail." - California Penal Code 463 PD.

California has not been in a state of emergency relative to the BLM riots beginning in May, but have been in a de facto state of emergency related to the coronavirus since March under orders from Governor Gavin Newsom.

According to the far-left DA, her new guidelines seemingly place a burden on the potential arresting officer(s) to go through the suspect's financial records to determine whether or not they needed to steal a 60" Samsung 4K flat screen television or a Chanel handbag and whether or not they'll sell the items or keep them for personal use.

The burden being placed on her officers makes it nearly impossible for them to properly do their jobs in order to maintain peace and civility within their communities. This is a sad reality for many, and it's no wonder why citizens and businesses are leaving the Democratic-led cities in droves. There's no need for a Starbucks, Gucci, or any other capitalist business for that matter in a socialist society where everyone is supposed to be equal, right?
